Please read these Terms of Service (“Terms,” “Terms of Service”) carefully before using the website located at https://www.e-2-d.org/ (the “Website”), operated by E2D, Inc., a nonprofit corporation formed in North Carolina, United States (“E2D,” “we,” “us,” or “our”). These Terms also govern your participation in E2D programs conducted through the Website, including device requests, event registration, and donations. Your access to and use of the Website is conditioned on your acceptance of and compliance with these Terms.

Your use of the Website is also governed by our Privacy Policy, available at www.e-2-d.org/privacy-policy, which is incorporated into these Terms by reference.

 

1. General Website Use

By accessing or using the Website, you agree to be bound by these Terms. If you disagree with any part of these Terms, you do not have permission to access or use the Website.

 

2. Mobile & SMS Messaging Terms

By providing your mobile phone number to E2D, you consent to receive automated text messages from us regarding our programs and services.

  • Types of Messages: Messages may include event invitations, laptop pickup notifications, customer support updates, and digital literacy resources.

  • Opt-Out Information: You can cancel or opt out of receiving SMS messages at any time. Text STOP to opt out. Text HELP for assistance, or contact us directly.

  • Message & Data Rates: Message and data rates may apply depending on your mobile carrier and plan.

  • Message Frequency: Message frequency varies based on your interactions with us and requested services.

  • Carrier Liability: Wireless carriers are not liable for delayed or undelivered messages.

  • Consent Is Not a Condition of Service: Consent to receive SMS messages is not a condition of receiving any device, service, or program benefit from E2D.

3. Donations & Subscriptions

We accept online donations through third-party payment processors. We are not responsible for the collection, use, or security of your billing information by these third-party payment processors, and your payment information is subject to their respective terms and privacy policies.

  • Non-Refundable: All standard donations made to E2D are non-refundable, except where a donation was made in error (for example, a duplicate charge or an incorrect amount), in which case please contact us within 30 days and we will review the request at our discretion.

  • Recurring Donations: Monthly subscription donations automatically renew every month until canceled. You may cancel your recurring donation at any time by contacting us or through your account on our donation platform. Cancellation requests submitted directly through our online donor portal take effect immediately. If requesting cancellation via email or phone, please submit your request at least 3 business days prior to your next scheduled charge date to ensure processing.

  • Tax Receipts: E2D is a 501(c)(3) nonprofit organization. Donation receipts for tax purposes will be provided in accordance with applicable IRS requirements.

 

4. Hardware Purchases & Pickups

  • Cosmetic Condition: E2D devices are refurbished and may display minor cosmetic imperfections, such as scratches or scuffs. Cosmetic damage does not impact device performance or functionality and is not grounds for replacement or return.

  • Three-Month Technical Warranty: E2D provides a firm, three-month technical warranty on all non-Apple laptops starting on the exact date of client receipt and ending three months later.

  • If a computer is out of warranty, E2D will not accept the device or perform repairs. Out-of-warranty clients may apply for another computer at the current participation rate.

  • Apple Products: Apple products are sold without any warranty. All Apple devices undergo rigorous quality control testing prior to distribution to ensure full operational condition.

  • No Refunds or Returns: All sales and distributions are final. E2D does not issue refunds or accept returns under any circumstances.

5. Prohibited Uses

You agree not to use the Website to:

  • Impersonate E2D, its staff, or representatives.

  • Send unauthorized advertising, spam, or promotional material.

  • Engage in automated scraping, data mining, or attempt unauthorized access to our servers or network.

  • Upload or transmit any material that is unlawful, harassing, or infringes the rights of others.

 

6. Intellectual Property

The Website and its original content, including text, graphics, logos, and the E2D name and brand, are the property of E2D, Inc. and are protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works from this content without our prior written consent, except for personal, non-commercial use or as otherwise permitted by law.

7. Suspension & Termination

E2D reserves the right, in its sole discretion, to suspend or terminate your access to the Website or to any program, without notice, for conduct that violates these Terms, is harmful to other users, E2D staff, or third parties, or exposes E2D to liability.

8. Disclaimer & Limitation of Liability

This Website and all content and services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express or implied. To the fullest extent permitted by law, E2D shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of, or inability to use, the Website, any device received through E2D, or any E2D program.

9. Indemnification

You agree to indemnify and hold harmless E2D, its officers, directors, employees, and volunteers from any claim, demand, loss, or damage, including reasonable attorneys’ fees, arising out of your use of the Website, your violation of these Terms, or your violation of any rights of a third party.

We may update these Terms from time to time. The “Last Updated” date at the top of this page reflects the most recent revision. Material changes will be posted on this page, and your continued use of the Website after changes take effect constitutes your acceptance of the revised Terms.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict of law provisions. Any controversy or claim arising out of these Terms shall be resolved in a court of competent jurisdiction in Mecklenburg County, North Carolina.
